New York Distilleries and Cider Makers Now Can Ship Directly to Consumers

New York Distilleries and Cider Makers Now Can Ship Directly to Consumers

Throughout New York State, the production of craft beverages has been surging. More craft cideries are located here than anywhere else in the nation, and we rank second in the number of craft distilleries. While small producers of spirits, cider and mead have boosted New York’s agricultural and tourism revenue, they still faced difficulty getting their beverages to customers due to antiquated laws governing liquor sales. Now, that has changed.

In 2024, Governor Kathy Hochul signed into law a bill allowing craft manufacturers of drinks such as whiskey, gin, bourbon, cider and mead to ship their products directly to consumers. This expansion mirrors similar rights that New York wineries have enjoyed since 2005, marking a new era for the state’s growing craft beverage sector.

During the COVID-19 lockdown, temporary direct-to-consumer (DTC) laws were enacted to help craft beverage producers continue operations while in-person sales were difficult or impossible. These laws proved highly successful, demonstrating that products could be shipped safely and responsibly while helping small businesses stay afloat. The new law makes these temporary measures permanent, offering craft cideries, distilleries and meaderies the same market access as wineries.

Under the new rules, craft beverage manufacturers can send their product to recipients across New York State without having to rely on traditional distribution networks that may limit market access. By eliminating intermediaries, these small businesses can retain a greater share of profits. Customers also benefit when they can order their favorite drinks straight from the source rather than finding a local outlet that sells a particular beverage. Simplifying distribution might also lead to lower costs.

By leveling the playing field between wine producers and other craft beverage manufacturers, the new law helps bolster a growing part of the state’s economy. As with the wine industry, craft beverage producers must adhere to stringent rules to ensure compliance with state alcohol laws. Age verification for online sales and responsible packaging practices are mandatory, ensuring that products reach consumers safely and lawfully.

If you’re a craft beverage producer navigating these new opportunities, consulting with a knowledgeable attorney can help ensure compliance and maximize the benefits of this groundbreaking law.
